Acceptable use policy

For the Internet to operate in a manner that satisfies the majority of its users, all users need to observe some rules and behaviours governing their use of the Internet. This policy explains what is and is not acceptable when using the Internet and to help you to get the best out of the Internet.

1. Objectives
The objective of this policy is to ensure compliance with applicable law, protect network resources, preserve our and your privacy and security and maximise the usefulness of our services and the Internet.

2. Interpretation
The provisions of this policy are intended as guidelines and are not meant to be exhaustive. Generally, conduct that violates law, regulation or the accepted norms of the Internet Community, whether or not expressly mentioned in this policy, is prohibited. We reserve the right at all times to prohibit activities that damage our commercial reputation and goodwill.

3. Security
You are prohibited from using the services to compromise the security, adversely affect or tamper with our system resources or accounts on our systems (including, but not limited to those of other Users), or at any other site accessible via our systems, without the explicit consent of the owner of such account and/or site. Malicious use or distribution of tools designed for compromising security is prohibited.

a. Any “denial of service”, attack, any attempt to breach authentication or security measures, or any unauthorised attempt to gain access to any other account, host or network will result in the immediate termination of services.

b. The security of the services used by you from your home is your responsibility.

c. Users are responsible for the security of their own devices that are directly or indirectly connected to our network. This includes (but is not limited to) PCs, wired and wireless home networking devices and games consoles.

d. We reserve the right to disconnect your connection without notice, if we identify that devices at the end of your connection are significantly impacting on our services or are part of a “botnet” (Devices hijacked to distribute malicious software or other forms of abuse).

4. Bandwidth usage
Regular bb4s customers enjoy an unlimited download allowance (with exception of economy packages). With no hidden costs.

Unacceptable Use

You must not use the services in any way that is unlawful, illegal or in any way to the detriment of other Internet Users. Furthermore, you must not allow anybody using your connection to use the services in any way that is unlawful or illegal or in any way to the detriment of other Internet Users. “Prohibited Material” shall be determined by us, at our sole discretion and shall include (but not limited to) the use of our service for the following purposes:

a. to send bulk or unsolicited email messages (commercial or otherwise), or;

b. to collect the responses from unsolicited email, or;

c. to promote any website whose Domain Name Service is provided by us,or;

d. to post advertisements or messages that are deceptive, misleading or otherwise and violate the charter of any newsgroup or mailing list;

e. to share your connection;

f. to use programs containing viruses, hoaxes or any tools designed to compromise the security of other websites and/or systems. However, you may pass examples to appropriate agencies in a safe manner for prevention purposes;

g. to sell or resell our services or products without our prior consent;

i. we reserve the right to decide whether a message violates the newsgroup or mailing list charter. In most cases we will defer to the judgement of the newsgroup or mailing list moderator or administrator;

ii. Commercial messages that are appropriate under the charter of a newsgroup or mailing list, or that are expressly solicited by the recipients are permitted;

iii. We reserve the right to inform and/or report the storage, distribution, transmission, retransmission or publication of Prohibited Material to relevant authorities and/or regulators, in addition to any action we may take as stated in this policy and/or any other materials which may constitute unlawful conduct by Users;

5. Forgery of Identity
Falsifying address information or otherwise modifying headers to conceal the sender´s or recipient´s identity, for the purpose of circumventing this policy, is prohibited This provision is not intended to disallow the use of aliases or anonymous re-mailers for any legitimate purpose.

Providing false information on sign up forms, contracts or on-line applications and/or fraudulent use of credit cards numbers will result in the immediate termination of services and the offender may be subject to civil or criminal liability.

6. Co-operation with Other Providers
Using our facilities to engage in activities that violate the terms of services of any other Internet Service Provider is prohibited. For example, but without limitation, sending unsolicited commercial email through our facilities to the subscribers of any Internet or on-line service provider that disallows unsolicited commercial e-mail is prohibited.

7. bb4s’ Right to Suspend, Restrict or Terminate Your Services
Violation of this policy may result in temporary suspension or permanent termination of one or more services at our sole discretion. We will determine what action is necessary on a case by case basis. We do not issue service credits for any outages incurred through service disablement resulting from policy violations.

The actions we may take include the following and are at our sole discretion:

i. a formal warning to you;

ii. suspension of your account (with or without notice);

iii. restriction of your access to the services or any part of the services; or

iv. termination of your account

8. Modification
We reserve the right to add, delete or modify any provision of this policy at any time without notice. Any such modification will be posted on our website and will become automatically effective upon all Users as from the date of posting.

i. We recommend that you visit our website regularly to check for updates or amendments to this policy.

9. Your Obligations and Warranties

You represent, undertake and warrant to us that you will use our services for lawful purposes and only as authorised herein. In particular, you represent, warrant and undertake to us that you will: keep secure and not disclose any password which may be given to you by us to third parties and that any such password will only be used for the authorised purpose communicated to you by us and further that you will notify us immediately of any known or suspected unauthorised use of the password;

i. observe the procedures which we may prescribe from time;

ii. not post, link or transmit to any of our servers any material which is unlawful, abusive, malicious, threatening, or defamatory in any way.

iii. not post, link or transmit to any of our servers any material which contains a virus or other hostile computer program or run any applications that could lead to a modification of the physical or logical structure of the networks being used;

iv. not post, link or transmit to any of our servers any material which constitutes or encourages the commission of a criminal offence or which infringes any patent, trade mark, design rights, copyright or any other intellectual property rights or similar rights of any persons.

v. adhere to laws for the protection of minors;

vi. respect the privacy of others and that you will not send unsolicited, harassing, slandering or threatening content;

vii. not use any names, documents, pictures or elements of our site so as to create the impression of any relationship whatsoever with any of our products or services, or of support for any of our products or services without our prior written consent;

viii. not develop or attempt to develop programs designed to bypass the user interface to access our program functions;

ix. treat all confidential and proprietary information and documents provided by us to you, including without limitation any password, as confidential and not to disclose the same to a third party;

x. comply with (and ensure that others using the services comply with) all applicable laws, statutes and regulations in connection with the Services. You are responsible for all use of your account, irrespective of use without your knowledge and/or consent;

xi. keep your contact details up to date;

xii. review email as part of the services on a regular basis, to enable us to advise you of any significant issues that may affect your use of the services.
